Welcome to Jobsmaal (accessible at https://jobsmaal.com). These Terms and Conditions (“Terms”, “Terms and Conditions”, “Agreement”) govern your relationship with Jobsmaal (“we”, “us”, or “our”) regarding your use of our website.

By accessing or using the Site, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Site.

1. Definitions

  • “Job Seeker” refers to any individual using the Site to search for or apply to job opportunities.
  • “Employer” refers to any company, organization, or individual posting job listings or searching the Site for potential candidates.
  • “User” refers to any individual or entity accessing or using the Site, including both Job Seekers and Employers.

2. User Accounts

To access certain features of the Site, you may be required to register an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete. You are solely responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate your account at our sole discretion, without notice, for any reason, including breach of these Terms.

3. Job Postings (For Employers)

As an Employer, you may post job listings on the Site. You agree that all job postings will be accurate, lawful, and comply with all applicable laws and regulations, including employment and anti-discrimination laws. You are solely responsible for the content of your job listings and any consequences arising from posting inaccurate, misleading, or fraudulent information. You agree not to post any job that requires an upfront payment from applicants or that violates any applicable laws. We reserve the right to remove any job posting at our sole discretion.

4. Job Applications (For Job Seekers)

As a Job Seeker, you may apply for jobs through the Site. You agree to provide accurate, truthful, and complete information in your application materials, including your resume, cover letter, and any other requested information. You are solely responsible for the content of your applications. You acknowledge that Jobsmaal is not responsible for the hiring decisions of Employers nor do we guarantee the accuracy or authenticity of any job listing. We encourage you to exercise caution and conduct your own due diligence before accepting any job offer.

5. Prohibited Activities

You agree not to use the Site for any unlawful purpose or in any way that could damage, disable, overburden, or impair the Site. You also agree not to engage in any of the following prohibited activities:

  • Post false, misleading, or fraudulent information.
  • Harass, intimidate, or threaten other Users.
  • Attempt to gain unauthorized access to the Site or other Users’ accounts.
  • Use automated means, including bots, spiders, or scrapers, to access the Site or collect User information.
  • Violate any applicable laws, regulations, or third-party rights.
  • Upload or transmit any viruses, worms, or other malicious code.

6. Intellectual Property

All content on the Site, including text, graphics, logos, icons, images, and software, is the property of Jobsmaal or its content suppliers and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or in any way exploit any of the content on the Site, in whole or in part, except for your own personal, non-commercial use.

7. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Jobsmaal, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the Site; (ii) any conduct or content of any third party on the Site; (iii) any content obtained from the Site; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.

8. Disclaimer of Warranties

Your use of the Site is at your sole risk. The Site is provided on an “AS IS” and “AS AVAILABLE” basis. The Site is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

Jobsmaal does not warrant that (i) the Site will function uninterrupted, secure, or available at any particular time or location; (ii) any errors or defects will be corrected; (iii) the results of using the Site will meet your requirements; or (iv) the Site is free of viruses or other harmful components.

9. Indemnification

You agree to defend, indemnify, and hold harmless Jobsmaal and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees) arising from: (i) your use of and access to the Site; (ii) your violation of any term of these Terms; (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your content caused damage to a third party.

10. No Fees Policy

Jobsmaal does not charge any fees for job seekers to access job postings, create a profile, or apply for jobs. If anyone contacts you requesting payment in our name, it is a scam and should be reported immediately to admin@jobsmaal.com. We reserve the right to introduce fees for certain services in the future with prior notice.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Site after those revisions become effective, you agree to be bound by the revised terms.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of Pakistan, without regard to its conflict of law provisions.
